WE HAVE BEEN WORKING BETWEEN THE SCHEDULES OF THE COASTAL COMMISSION AND HEARING BACK FROM THE APPLICANT, AS WELL AS STAFF WORKING ON THE STAFF REPORT A LITTLE BIT MORE.

WE'RE STILL WORKING TOWARDS HOPEFULLY AUGUST 19TH.

UH, WE, WE HAVE STILL WAITING FOR ONE MORE MEETING WITH THE COASTAL COMMISSION BEFORE THE APPLICANT CAN, UH, CONCLUDE THEIR WORK AND WE CAN BRING BACK THAT.

SO LAST NIGHT I WAS OUT WATERING MY VEGETABLES IN THE GARDEN AND A TRUCK PULLED UP IN FRONT OF MY STREET AND THIS TRUCK HAS DIESEL ENGINE.

AND I WAITED A FEW MINUTES AND I WENT OUT TO HIM.

HE CONTINUED TO IDLE.

IT WAS ABOUT 5:00 PM AND I SAID TO HIM, COULD YOU PLEASE TURN OFF YOUR ENGINE? HE SAID, NO.

I SAID, THERE'S A TRUCK STOP

OVER ON TIDELANDS AVENUE, OR YOU COULD JUST DRIVE THIS TRUCK DOWN THE STREET A LITTLE BIT AWAY FROM MY HOME.

HE WENT BACK INTO HIS TRUCK WITH A BOTTLE OF ALCOHOL AND PUT UP THE, THE CURTAINS IN THE CAR TRUCK CAB, AND STAYED ALL NIGHT IDLING OVER 15 HOURS.

UM, I WROTE, AND MR. REEDER AND I USED UP SOME OF MY TIME THERE, BUT I WROTE A WHOLE DETAILED, UH, DESCRIPTION OF WHAT HAPPENS IN THAT CASE.

HOWEVER, I LOOKED AT CARB, HAVE THOSE COPIES FOR YOURSELF, BUT I ALSO BROUGHT ONE FOR STAFF IN A SMALLER VERSION THAT CAN BE USED AS A HANDOUT TO TRUCKERS.

AND BOTH THE WORKING AND THE CODE OFFICERS, I FEEL, SHOULD BE ABLE TO GO OUT TO THE TRUCKERS AND TO EXPLAIN TO 'EM THAT CALIFORNIA LAW IS A FIVE MINUTE IDLING TIME WHEN IT'S CLOSE TO A HOSPITAL, A SCHOOL, A HEALTHCARE SECONDS FACILITY, 15 SECONDS, AND A RESIDENCE.

SO IF WE COULD GET THOSE PASSED OUT, WE WI WOULDN'T BE BREATHING HAVING THE, THE PARTICULATE IN MY LUNGS, IN MY EYES, OR ON MY VEGETABLES.

AND I THINK IT'S JUST GOOD INFORMATION THAT THIS TRUCKER AND I DON'T NEED TO HAVE ANY KIND OF, UH, BACK AND FORTH THAT HE WOULD UNDERSTAND.

I WAS HERE FOR THE LAST MEETING, PLANNING MEETING WHEN THE USDG FUELS TRANSFERRED DEPO, UH, PROJECT, UH, PUBLIC HEARING WAS PULLED FROM THE AGENDA.

I KNOW THE PROJECT IS NOT ON TONIGHT'S AGENDA, BUT BEFORE IT APPEARS AGAIN, I ASK THAT ALL ON THE COMMISSION REFLECT UPON THE MUCH WELCOME PROGRESS THE CITY OF NATIONAL CITY HAS COMMITTED TO MAKE IN REVERSING TERRIBLE HEALTH IMPACTS OF THE PAST.

LETTING THIS INFLUENCE THE PROJECT OUTCOME.

FOR ONE, CONSIDER THE STATEMENTS INCLUDED IN THE HOUSING ELEMENT UPDATE OF THE GENERAL PLAN FROM AUGUST OF 2021.

THESE INCLUDE THE FOLLOWING.

STATE HOUSING LAW HAS DECLARED THAT THE AVAILABILITY OF DECENT HOUSING AND A SUITABLE LIVING ENVIRONMENT IS A VITAL STATEWIDE IMPORTANCE AND A PRIORITY OF THE HIGHEST ORDER.

GOAL SEVEN WAS TO PRO PROMOTE AN ECONOMICALLY VIABLE, ENVIRONMENTALLY CONSCIOUS AND SOCIALLY EQUITABLE LAND USE AND DEVELOPMENT PATTERN.

POLICY 7.4 WAS TO ENCOURAGE MEASURES THAT SUPPLEMENT TITLE 24 AND SUPPORT PROGRESS TOWARDS NATIONAL CITY SUSTAINABILITY AND CLIMATE ACTION PLAN GOALS.

ALSO CONSIDER THE PLANS TO GUIDE DEVELOPMENT OF THE DOWNTOWN DISTRICT AND WEST SIDE OLD TOWN AREAS.

THESE SPECIFIC PLANS ENVISION SUPPORTING THE EXISTING COMMUNITY TO ESTABLISH GROWING VIBRANT NEIGHBORHOODS THAT ENCOURAGE A MIX OF HOUSING, RETAIL SERVICES AND EMPLOYMENT CENTERS TO SUPPORT THE ECONOMY AND CHARACTER OF NATIONAL CITY.

THE WEST SIDE SPECIFIC PLAN ADDRESSES REDEVELOPMENT OF UNDERUTILIZED LANDS TO PROVIDE OPPORTUNITIES FOR INCREASED USE OF PUBLIC TRANSIT IN ADDITION TO ACCOMPLISHING NEIGHBORHOOD REVITALIZATION GOALS.

UM, ZONING IN THE 2010 WEST SIDE PACIFIC PLAN INCLUDES THE MULTI-USE COMMERCIAL RESIDENTIAL ONE AND TWO, UH, ZONES WITH A GOAL TO INCREASE HOUSING OPTIONS FOR A DIVERSITY OF HOUSEHOLD TYPES.

THE MIXED COMMERCIAL ZONES ARE APPLIED TO AREAS GENERALLY BORDERING THE RS FOUR ZONE TO TRANSITION TO MULTIFAMILY RESIDENTIAL AND THE DOWNTOWN COMMERCIAL AREA.

THE MCR ZONE, UH, PROVIDE FOR MULTIFAMILY DEVELOPMENT EITHER AS RENTAL STOCK OR HOME OWNERSHIP CONDOMINIUMS FOR THE RS FOUR RESIDENTIAL SINGLE FAMILY AREAS.

IT ALSO ALLOWS FOR THE CONTINUATION OF EXISTING MIXTURE OF HOUSING TYPES AND ENCOURAGES INFILL WITH SINGLE FAMILY ZONES 15 SECONDS.

SO BRINGING THE, UH, USDG FUELS TRANSFER DEPO INTO EXISTENCE HARDLY SEEMS TO ALIGN WITH THESE AND OTHER STATED GOALS INTENDED TO YIELD A BETTER, HEALTHIER NATIONAL CITY.

AGAIN, PLEASE CONSIDER THESE AS YOU, UH, GO FORWARD WITH THE USDG FIELDS PROJECT.

HERE'S AN OVERVIEW OF THE RESTAURANT.

IT'S LOCATED ON THE CORNER OF EAST EIGHTH STREET AND PALM.

IT'S THE ONLY ESTABLISHMENT ON THAT LOT.

SO SUSHI AND GONE IS AN EXISTING 2,400 SQUARE FOOT RESTAURANT LOCATED IN THE MXC TWO ZONE.

THERE WAS A PREVIOUS ALCOHOL CUP APPROVED IN 2021 WHEN IT WAS K BUROUGHS.

THEY WERE APPROVED FOR ALCOHOL SALES FROM 7:00 AM TO 12:00 AM DAILY.

HOWEVER, THAT USE HAS SINCE BEEN DISCONTINUED.

AS I MENTIONED BEFORE, THE PRO OR THE RESTAURANT'S LOCATED ON THE NORTHWEST CORNER OF EAST EIGHTH STREET AND PALM AVENUE.

IT'S SURROUNDED BY COMMERCIAL AND RESIDENTIAL USES.

THE PROPERTIES DIRECTLY ABIDING THE RESTAURANT ARE COMMERCIAL AND RETAIL.

HOWEVER, THERE ARE SOME RESIDENCES THAT ARE LOCATED NEARBY, UM, BUT THEY ARE SEPARATED BY A PRETTY SUBSTANTIAL GRADE CHANGE.

HERE'S A FRONT VIEW OF THE RESTAURANT FROM PALM AVENUE, AND THEN HERE'S A VIEW FROM EAST EIGHTH STREET WHERE YOU CAN KIND OF START TO SEE THAT PRETTY SUBSTANTIAL GRADE CHANGE BETWEEN THE RESTAURANT AND THE NEIGHBORING USES.

SO THE APPLICANT IS PROPOSING BEER AND WINE SALES AND LIVE ENTERTAINMENT AT THE RESTAURANT.

THEIR PROPOSED HOURS FOR ALCOHOL SALES ARE FROM 8:00 AM TO MIDNIGHT DAILY, AND THEN THEIR PROPOSED HOURS FOR LIVE ENTERTAINMENT ARE FROM 11:00 AM TO 10:00 PM SUNDAY THROUGH THURSDAY, AND FROM 11:00 AM TO 11:00 PM FRIDAY AND SATURDAY.

THE LIVE ENTERTAINMENT WILL CONSIST OF DJS, BANDS, GUITARISTS, ET CETERA.

AND THEN THE FLOOR PLAN WILL INDICATE THE DINING AREA AS WELL AS THE PROPOSED LIVE ENTERTAINMENT AREA.

AND IT SHOULD BE KNOWN THERE'S ABOUT 52 SEATS AVAILABLE IN THE RESTAURANT.

THERE ARE ADDITIONAL REQUIREMENTS FOR ALCOHOL CCPS, INCLUDING EXTENDED MAILING FOR ALL OWNERS AND OCCUPANTS WITHIN 660 FEET.

WE SENT 341 NOTICES.

THE RESTAURANT WAS ALSO REQUIRED TO HOLD A COMMUNITY MEETING.

IT WAS HELD ON MAY 7TH.

THERE WERE NO ATTENDEES.

UH, THIS SITE IS LOCATED IN CENSUS TRACT ONE 18.02.

THERE'S CURRENTLY TWO ON SALE LICENSES WHERE NINE ARE RECOMMENDED.

SO THE CENSUS TRACT IS NOT CONSIDERED OVER CONCENTRATED EVEN WITH THE ADDITION OF ANOTHER LICENSE.

THE POLICE DEPARTMENT ALSO PROVIDED A COMMENT RELATED TO EXTERIOR LIGHTING.

WE ALSO RECEIVED COMMENTS FROM THE INSTITUTE FOR PUBLIC STRATEGIES.

THEY INCLUDED THEIR STANDARD CONDITIONS, WHICH REQUIRES IN-PERSON RESPONSIBLE BEVERAGE.

SO A LITTLE BACKGROUND.

UH, THE TABLE REGULATES DEVELOPMENT STANDARDS IN THE MX C ONE ZONE, SO IT INCLUDES MINIMUM AND MAXIMUM STANDARDS FOR SETBACKS, HEIGHT, FLOOR AREA DENSITY, ET CETERA.

CURRENTLY, THE MAXIMUM HEIGHT LISTED IN THE TABLE IS 50 FEET AND THREE STORIES.

CURRENTLY, ALL ZONES WITHIN NATIONAL CITY MEASURE MAXIMUM HEIGHT IN FEET AND NUMBER OF STORIES.

UM, PER THE CALIFORNIA BUILDING CODE, THE MAXIMUM STORY HEIGHT IS 14 FEET.

SO A THREE STORY BUILDING COULD NOT BE TALLER THAN 42 FEET, NOT INCLUDING ANY ROOF ARTICULATION.

WHILE THE MINIMUM CEILING HEIGHT IS SEVEN FEET, SEVEN FEET, SIX INCHES, WHICH WOULD ALLOW A LOT MORE THAN THREE STORIES WITHIN 50 FEET.

SO THE DIFFERENCE BETWEEN HEIGHT AND FEE AND NUMBER OF STORIES ALLOWS DESIGNS THAT INCORPORATE ROOF ARTICULATION AND MECHANICAL SCREENING.

HOWEVER, THE LARGE GAP ALSO REMOVES FLEXIBILITY FOR VARIATION IN BUILDING MASS WHEN MAXIMIZING THEIR FLOOR AREA.

THIS CAN REDUCE FLEXIBILITY AND RESULTS IN PROJECTS WITH FEWER UNITS OR AVAILABLE COMMERCIAL SPACE.

AS SUCH, PROJECTS IN THE MX C ONE ZONE HAVE HAD DIFFICULTY DEVELOPING TO THEIR MAXIMUM POTENTIAL.

ADDITIONALLY, THERE ARE OTHER DEVELOPMENT STANDARDS THAT LIMIT THE SIZE AND BULK OF BUILDINGS IN THE MX C ONE ZONE, SUCH AS THE MAX HEIGHT, WHICH IS 50 FEET.

THE MAX FLOOR AREA RATIO, WHICH IS ONE FOR SINGLE USE PROJECTS AND TWO FOR MIXED USE PROJECTS.

AND THE MAX DENSITY, WHICH IS 48 DWELL UNITS PER ACRE.

IN 2023, THERE WAS AN AMENDMENT TO HOW HEIGHT WAS MEASURED ON SLOPE LOTS.

IT WAS CHANGED TO AN AVERAGE GRADE MEASUREMENT.

THIS REDUCED THE NEED FOR DISCRETIONARY APPROVALS AS WELL AS REDUCING OVERALL BUILDING COSTS.

AND IT IMPROVED CONSISTENCY WITH STATE LAW AND THE FOCUSED DRONE OPINE UPDATE INCREASING THE PERMITTED NUMBER OF STORIES WILL BE COMPLIMENTARY TO THIS RECENT AMENDMENT, AND IT WOULD PROVIDE ADDITIONAL RELIEF FOR LOTS WITH TOPOGRAPHICAL

CHALLENGES.

SO LOTS COULD HAVE THREE STORIES ON THE HIGHEST POINT OF THE SLOPE, AND FOUR STORIES ON THE LOWEST POINT OF THE SLOPE.

SO THE APPLICANT HAS PROPOSED TO INCREASE THE MAXIMUM NUMBER OF STORIES PERMITTED IN THE MX ONE ZONE, FROM THREE STORIES TO FOUR STORIES.

STAFF IS ALSO SUGGESTING THE SAME, SAME INCREASE FOR THE MXD ONE ZONE, SINCE THEY HAVE THE SAME DEVELOPMENT STANDARDS.

THERE IS CURRENTLY NO PROPOSED CHANGES TO THE MAX HEIGHT IN FEET, THE FAR OR DENSITY, THIS REQUEST IS BASED ON THE 120 UNIT FOUR STORY MULTIFAMILY DEVELOPMENT IN THE MX C ONE ZONE, OR A PROPOSED 120 UNIT FOUR STORY DEVELOPMENT.

UM, CURRENTLY THAT PROPOSED PROJECT IS MEETING MAXIMUM HEIGHT IN FEET AND THE FAR WITH THEIR FOUR STORY DESIGN.

SO IF THE BUILDING IS RESTRICTED TO THREE STORIES, THE OVERALL PROJECT MAY NEED TO BE REDUCED.

THIS REDUCTION COULD TAKE PLACE IN PARKING, OPEN SPACE, OR EVEN UNIT COUNTS.

UH, THIS IS THE PERTINENT PORTION OF THE TABLE.

SO AS YOU CAN SEE, THE MAXIMUM HEIGHT IS CURRENTLY LISTED AS 50 FEET AND THREE STORIES.

AND THEN STAFF IS SUGGESTING THE FOLLOWING CHANGE, WHICH IS 50 FEET AND FOUR STORIES.

AND THEN HERE'S JUST A LITTLE GRAPHIC TO KIND OF SHOW YOU WHAT THAT WOULD LOOK LIKE.

UM, SINCE THERE'S NO INCREASE TO THE HIGH OF THE BUILDING IN FEET, UM, ADDING ANOTHER STORIES REALLY MINIMAL TO THE OVERALL BUILDING.

SO MOVING ON TO THE ANALYSIS, UH, THE INTENT OF THE MX C ONE ZONE IS TO ENSURE EXCELLENCE IN SITE PLANNING AND BUILDING DESIGN TO CREATE VIBRANT AND WELL-DEFINED PUBLIC REALM.

UM, CREATING PEDESTRIAN FRIENDLY AND SUPPORTIVE SUSTAINABLE WAY OF LIFE.

BY INCREASING THE NUMBER OF PERMITTED STORIES FROM THREE TO FOUR, UM, WE'D BE PROVIDING GREATER SITE DESIGN FLEXIBILITY, SO THAT WOULD BE MEETING THE INTENT OF THE ZONE.

AND IT ALSO GIVES PROJECTS THE OPPORTUNITY TO BUILD UP INSTEAD OF OUT, WHICH CREATES NEW SPACE THAT CAN BE UTILIZED FOR THE BENEFIT OF THE RESIDENTS, LIKE GREEN SPACE, COMMON OPEN SPACE AND PARKING.

AND AGAIN, THERE ARE NO PROPOSED CHANGES TO THE MAX HEIGHT IN FEE, THE FAR OR DENSITY.

SO THERE'S NO INCREASE IN AMOUNT OF BUILDING AREA GRANTED.

AND ALL OF THESE PROJECTS WOULD BE REQUIRED TO MEET THESE DEVELOPMENT STANDARDS THAT CONTRIBUTE TO THE MXC ONE ZONE CHARACTER.

RECENTLY THE MXT ZONE WAS ADDED AS PART OF THE FOCUS GENERAL PLAN UPDATE.

THAT ZONE HAS A HEIGHT LIMIT OF 45 FEET AND FOUR STORIES.

SO IN ADDITION TO THAT, WE WANTED TO MAKE THE CHANGE TO ALLOW THE MXC ONE ZONE AND THE MXD ONE ZONE TO HAVE 50 FEET AND FOUR STORIES.

AND AS I MENTIONED BEFORE, STAFF IS SUGGESTING INCLUDING THE MXD ONE AS PART OF THIS INITIATION PROCESS SINCE IT HAS THE SAME HEIGHT AND NUMBER OF STORIES REQUIREMENTS.

THE REQUEST IS ALSO CONSISTENT WITH THE GENERAL PLAN BECAUSE IT INCREASES THE LIKELIHOOD OF INFILL DEVELOPMENT AND PROMOTES DEVELOPMENT OF UNDERUTILIZED LAND BY PROVIDING GREATER DESIGN FLEXIBILITY FOR SMALL LOTS AND LOTS WITH TOPOGRAPHIC CHALLENGES.

AND THEN YOU CAN SEE THOSE TWO GENERAL PLAN POLICIES LISTED BELOW.

SO THE OPTIONS TONIGHT ARE INITIATE PROCEEDINGS TO AMEND TITLE 18 OF THE NATIONAL CITY MUNICIPAL CODE OR FILE THE REPORT AND DENY THE REQUEST.

UM, WE'RE IN THE PROCESS OF CREATING A, A PARCEL FOR THAT.

THE BUYRIGHT, UH, DWELLING UNITS PER ACRE IS 48, SO THAT GETS US TO THE ONE 20.

UM, BUT THE ISSUE THAT WE HAVE HERE WITH THE THREE STORY RESTRICTION, UM, 50 FEET IS WELL WITHIN, UM, OUR, OUR BUILDING HEIGHT.

WE'RE ACTUALLY AT 45 FEET AT FOUR STORIES.

BUT THE ISSUE WITH, WITH, UH, THREE STORY LIMIT IS IT REALLY RESTRICTS THE NUMBER OF UNITS THAT WE COULD DELIVER TO THE COMMUNITY.

IN FACT, UM, IF WE WERE TO ELIMINATE THE FOUR STORIES, WE WOULD LOSE 29 UNITS.

AND THAT OF COURSE, COMES TO THE EXPENSE OF THE COMMUNITY IN TERMS OF FEWER UNITS, IT WOULD AFFECT AFFORDABILITY.

UM, AND THAT'S, UM, WE ALL KNOW THERE'S A HOUSING SHORTAGE IN CALIFORNIA, AND THAT'S NOT, NOT SOMETHING THAT WE WANT TO DO.

UM, AGAIN, 50 50 FEET IS WELL WITHIN OUR LIMIT.

UM, AND JUST AS, UM, KIND OF A COUNTERPOINT, THE PARCEL DIRECTLY TO THE EAST, WHICH IS RESIDENTIAL, AND I THINK ZONED RN TWO HAS A HEIGHT LIMIT OF SIX STORIES.
