I'VE BEEN HELPING WITH FENTANYL FORUMS THROUGHOUT THE REGION, UM, EDUCATING PARENTS AND STUDENTS AND COMMUNITY MEMBERS ABOUT THE DANGERS OF FENTANYL. AND IN ONE OF THE PROGRAMS COMING UP, UH, FORMER DEA AGENT ROCKY HERON IS GOING TO SHARE HIS FIRSTHAND EXPERIENCES ALONG WITH LAURA BRINKER WHITE, WHO LOST HER TEENAGE SON TO FENTANYL. HER SON CONNOR, ATTENDED HIGH SCHOOL IN SAN DIEGO. HE TOOK A PILL GIVEN TO HIM BY A FELLOW STUDENT BECAUSE HE THOUGHT THE PILL WOULD HELP HIM COPE WITH ANXIETY. HE WAS UNAWARE THE PILL WAS COUNTERFEIT AND CONTAINED A DEADLY DOSE OF FENTANYL. THROUGH MY JOB, I'VE COME TO KNOW [00:05:01] LAURA AND MANY OTHER PARENTS WHO HAVE LOST THEIR TEENAGE AND YOUNG ADULT CHILDREN TO FENTANYL. THERE ARE COMMON THREADS IN ALL OF THESE DEATHS. MOST WERE TAKING PILLS TO TRY TO DEAL WITH MENTAL HEALTH ISSUES. NONE KNEW THE DRUGS THEY WERE TAKING WERE COUNTERFEIT AND CONTAINED FENTANYL. AND ALL OF THEM BEGAN THEIR DRUG USE JOURNEY WITH MARIJUANA. AGAIN, TRYING TO COPE WITH MENTAL HEALTH ISSUES. IF WE ARE TO COMBAT THE SCOURGE OF FENTANYL, WE MUST BEGIN WHERE THE DRUG JOURNEY BEGINS. JESUS CARDENA REPORTEDLY WAS MAKING TENS OF THOUSANDS FROM MARIJUANA LOBBYISTS AT THE TIME, WHITBURN PUSHED TO EASE MARIJUANA LAWS. FORMER SUPERVISOR NATHAN FLETCHER'S, ONE TIME CHIEF OF STAFF ALLEN YOUNG, WAS CONNECTED TO THE INDUSTRY AND IMPACTED MARIJUANA POLICY IN THAT CITY. SUPERVISORS TARA LAWSON REAMER AND NORA VAGAS VARGAS REPORTED RECEIVING REPORTEDLY RECEIVED CAMPAIGN CONTRIBUTIONS FROM THE INDUSTRY. ALL HAVE PUSHED THE HEMIN FOR MARIJUANA BUSINESS EXPANSION IN RURAL AREAS WITHOUT RESIDENTS ASKING OR VOTING FOR IT. MY POINT IS, ONE CANNOT HELP BUT SEE THE DEEP TIES TO AND POLITICAL CONTRIBUTIONS FROM THE CANNABIS INDUSTRY REFLECT IN FAVORABLE POLICY DECISIONS. PRIVATE CITIZENS LIKE MYSELF, ESPECIALLY THOSE ENGAGED IN PUBLIC HEALTH, ARE WEARY OF THIS HIGHLY FUNDED INDUSTRY. NOT ONLY INFLUENCING POLICY, BUT OVERRIDING ANY OPPOSITION. SHE GOES ON TO SAY THAT AS THC PRODUCTS BECOME MORE AVAILABLE AND POTENT, WE MUST PROTECT CHILDREN FROM ACCIDENTAL POISONINGS. I QUOTE, WE NEED LEGISLATION THAT RESTRICTS COFFEE. CAPT PACKAGING REQUIRES CHILD RESISTANT PACKAGING THAT COMPLIES WITH THE POISON PREVENTION PACKAGING APPS AND LIMITS THE QUANTITY OF THC IN EACH SERVING SIZE. DISTRICT ATTORNEY SUMMER STEPHAN HAS TAKEN A STRONG POSITION RECENTLY IN EDUCATING AND ENFORCING AGAINST THE SALE OF FLAVORED TOBACCO PRODUCTS THAT MIMIC POPULAR FLAVORS AND CANDIES THAT ARE ATTRACTED TO CHILDREN. [00:10:01] RECENT DATA FROM 2021 NATIONAL SURVEY ON DRUG USE AND HEALTH PROVIDES EVIDENCE THAT FOCUS SPECIFICALLY ON YOUNGER UNDERAGE DRIVERS THAT CORRELATE DUI OF MARIJUANA AND ALCOHOL AMONG DRIVERS AGES 16 TO 20. IN THE US THE PREVALENCE OF DUI ALCOHOL WAS 6.1% AMONG YOUTH WHO REPORTED PAST ALCOHOL CONSUMPTIONS. BUT THE MAJORITY REPORTING DUI WITH ALCOHOL ALSO REPORTED DUI WITH MARIJUANA. THE REPORTS SHOW THAT THE PREVALENCE OF DUI WITH MARIJUANA WAS 24.5%. THE REPORT INDICATES THAT DUI WAS MORE LIKELY TO BE UNDER THE INFLUENCE OF MARIJUANA THAN ALCOHOL. THE REPORT CONCLUDES MORE THAN 1 MILLION DRIVERS EACH YEAR ARE PLACING THEIR LIVES AND THOSE AT THE PUBLIC AT RISK BY OPERATING MOTOR VEHICLES AFTER CONSUMING MARIJUANA OR ALCOHOL. THESE FINDINGS UNDERSCORE THE IMPORTANCE OF THE PREVENTION EFFORTS NEEDED TO TARGET UNDERAGE MARIJUANA AND ALCOHOL IMPAIRED DRIVERS. LOOKING AT THE DATA, IT'S CONCERNING THAT THE CITY'S, UH, RECENT INTEREST IN GROWING THE MARIJUANA BUSINESS IN THE COMMUNITY, EVEN KNOWING THE INFLUENCES AND HARM OF MARIJUANA TO OUR YOUTH AGES 16 TO 20. PARTICULARLY SINCE WE'RE NOT AN ISOLATED COMMUNITY , WE'RE BOUNDED ON THREE SIDES BY THE TWO LARGEST JURISDICTIONS. AND SO THEY THINK THAT IF THE COURT WERE TO OVERRULE MARTIN, THEN THEY CAN SEND THEIR POLICE DEPARTMENT OUT AND SIMPLY THREATEN PEOPLE WITH SAYING, GET OFF THE PUBLIC SPACE, OR WE'RE GONNA ARREST YOU. THE POINT I WANNA MAKE TO YOU, THAT'S A FARCE IN SAN DIEGO COUNTY. WE DON'T HAVE THE JAIL SPACE. EVEN IF THE COURT DID THAT, IT'S GONNA DO NOTHING AS A PRACTICAL MATTER HERE. ONE THING IS, THE MOMENT YOU GUYS START TO SET UP, IT GOES ALL OVER SOCIAL MEDIA AND EVERYONE KNOWS YOU DON'T GO IN FRONT OF, UH, THE IN AND OUT, SHALL WE SAY, ON UH, 24TH STREET OR, YOU KNOW, WHICHEVER OR IN FRONT OF SWEETWATER HIGH SCHOOL OR WHEREVER IT'S BEING SET UP AT. SO THE BACKGROUND, UH, NATIONAL CITY MUNICIPAL CODE SECTION 18 10 0 6 OH REGULATES RULES OF MEASUREMENT, UH, WITHIN OUR ZONING CODE, UH, THINGS RELATED TO DISTANCES, HEIGHTS, LOT, WIDTH FLOOR AREA. IT REALLY TELLS THE PLANNERS HOW TO EVALUATE DIFFERENT LAND USE REQUIREMENTS. UH, SUBSECTION E DEALS SPECIFICALLY WITH MEASURING HEIGHT, UM, AND IT READS, UH, HEIGHT IS MEASURED AS THE VERTICAL DISTANCE FROM THE HIGHEST POINT OF ANY STRUCTURE TO THE GROUND LEVEL DIRECTLY BELOW. UM, BUT WHAT WE'LL SEE IN THIS PRESENTATION IS THAT ON SLOPE LOTS, THIS RESULTS IN A NEED TO HAVE A PARTICULAR TYPE OF STEP BUILDING, UM, WHICH COULD CREATE SIGNIFICANTLY MORE EXPENSIVE CONSTRUCTION AND HAVE LESS POTENTIAL TO USE THE FLOOR AREA THAT WOULD BE ALLOTTED TO THAT LOT. UM, CURRENTLY, IF A PROPOSAL COMES IN, IT COULD RESULT IN A REQUEST FOR A ZONE VARIANCE TO MEET THE HEIGHT REQUIREMENTS. UM, AND SO AN AVERAGE GRADE DEFINITION COULD POTENTIALLY ALLOW MORE PROJECTS IN THE CITY. SO THE PROPOSAL IS STAFF IS SUGGESTING TO USE THIS AVERAGE GRADE MEASUREMENT. THIS WOULD ALLOW THE MEASUREMENT OF THE BUILDING TO BE TAKEN FROM THE AVERAGE GRADE OF THE LOT RATHER THAN THE, UM, THE, UH, HEIGHT FROM THE GROUND LEVEL TO ALL POINTS OF THE BUILDING. REGULAR, REGULARLY SHAPED LOTS WITH NOT MUCH TOPOGRAPHY WOULD BE MOSTLY UNAFFECTED BY THIS CHANGE. UM, BUT AS, AS WE HAVE, AS WE HAVE SEEN CHANGES WITH STATE REGULATIONS LOTS THAT PREVIOUSLY WERE NOT REALLY FEASIBLE TO DEVELOP OR NOW BEING LOOKED AT, UH, THESE WILL INCLUDE THESE, UH, IRREGULAR SHAPES AND LOTS WITH SIGNIFICANT SLOPES. SO WHEN YOU START TO PROPOSE A BUILDING ON A SLOPE LOT, YOU'RE GONNA HAVE THIS STEPPED EFFECT TO STAY UNDER THAT HEIGHT LIMIT. IT'S NOT GONNA BE, YOU USUALLY DON'T SEE A BUILDING THAT FOLLOWS THE SLOPE WITH THE ROOF. MM-HMM, . UM, AND THE PROPOSED CHANGE IS TO MAKE IT A LITTLE MORE FLEXIBLE. SO INSTEAD OF MEASURING AT ALL POINTS IN THE LOT, WE WOULD JUST HAVE THE AVERAGE GRADE OF THE LOT AND 65 FOOT HEIGHT LIMIT FROM THAT. SO YOU COULD HAVE A MORE REGULARLY SHAPED BUILDING. UH, PERHAPS IF IT'S ON A SLOPE, YOU COULD TUCK SOME PARKING UNDERNEATH ON THE BACK END. UM, BUT WHEN YOU'RE DEALING WITH BUILDING CODES, UH, ELEVATORS, MECHANICAL EQUIPMENT, CORRIDORS, FIRE REQUIREMENTS, UM, HAVING MORE FLEXIBILITY IN HOW YOU DESIGN YOUR BUILDING, UH, CAN REALLY MAKE A PROJECT MORE FEASIBLE. SO, ONCE AGAIN, THE EXISTING LANGUAGE, UH, IT'S SPLIT INTO TWO PARTS. ONE IS GENERALLY HOW HEIGHT IS CONSIDERED, UH, AND THEN WE HAVE [01:40:01] THIS, THIS KIND OF LONGER DEFINITION FOR SLOPE LOTS, UM, WHICH AS I SAID EARLIER, IT DEALS WITH, UH, MEASURING THE HEIGHT AT ALL POINTS OF THE BUILDING RATHER THAN JUST ONE POINT. UM, AND WE PROPOSE STAFF IS PROPOSING TO BASICALLY REMOVE THE SECTION ON SLOPE LOTS AND JUST ADD A LITTLE, UH, ENDING POINT TO THE GENERAL, UH, DEFINITION SAYING STATING ON SLOPE LOTS, THE HEIGHT SHALL BE MEASURED FROM THE AVERAGE GRADE TO THE PULSE POINT OF THE STRUCTURE. UM, THE NEW STRUCTURE THAT'S PROPOSED. SO AS AN ANALYSIS, THE LAND USE CODE WAS WRITTEN PRIOR TO MIXED USE COMING INTO PLAY. UM, OUR DENSER MIXED USE ZONING DISTRICTS DIDN'T BEGIN UNTIL 2012, I BELIEVE. UM, SO HISTORICALLY NATIONAL CITY HASN'T SEEN A LOT OF LARGER DEVELOPMENTS. UM, BUT WITH THE INCREASE IN PRESSURE TO BUILD MORE HOUSING IN CITIES, UH, WE'RE SEEING MORE HIGHER DENSITY PROJECTS. WE'RE SEEING AFFORDABLE PROJECTS, DENSITY BONUS PROJECTS. UM, AND THIS CODE SECTION CAN BE CHALLENGING FOR, UM, SOME PROPOSALS ON, YOU KNOW, LOTS THAT HAVEN'T PREVIOUSLY BEEN DEVELOPED. UM, AND IT CAN BE A BIT INFLEXIBLE FOR THOSE PROPOSALS. UM, ONCE AGAIN, THE STATE LEVEL IS MANDATING MORE FLEXIBILITY ON, ON WHAT CAN BE BUILT IN CITIES. AND THEN, UH, IT IS IMPORTANT TO NOTE THAT, UM, COMING DOWN THE PIPELINE, WE HAVE OUR FOCUSED GENERAL PLAN UPDATE AND A PROGRAM CALLED HOUSE NATIONAL CITY, UH, WHICH WILL ALSO PROVIDE A PATHWAY FOR DEVELOPMENTS TO OCCUR. UM, HOUSE NATIONAL CITY, THE PENDING PROGRAM IS A FAR BONUS PROGRAM, FLOOR AREA BONUS PROGRAM. UM, AND THAT HAS A, AN ELEMENT INTO IT THAT DOESN'T ALLOW THOSE BUILDINGS TO EXCEED THE HEIGHT LIMITS OF THE ZONE, UM, THAT THEY'RE PROPOSING. SO THIS WOULD PROVIDE MORE FLEXIBILITY FOR, UH, PROPOSALS UNDER HOUSED NATIONAL CITY. SO THE FINDINGS FOR THIS PROPOSED CO CODE AMENDMENT, UH, CONFORMANCE WITH OUR GENERAL PLAN, YOU KNOW, IT, IT INCREASES THE LIKELIHOOD OF DEVELOPMENT ON INFILL LOTS THAT HAVE NOT SEEN DEVELOPMENT DUE TO THEIR TOPOGRAPHY OR THEIR SIZE. UM, IT COULD POTENTIALLY LEAD TO AN INCREASE IN THE CITY'S HOUSING STOCK, UH, AND BY REDUCING CONSTRUCTION COSTS, POTENTIALLY ALSO REDUCING THE COST OF RENTS IN THOSE NEW BUILDINGS AS WELL. UM, FOR CQA, UH, IT'S EXEMPT FROM CQA AS BEING CONSIDERED NOT A PROJECT. THERE'S NO DENSITY INCREASE THAT WOULD BE, UH, AFFORDED WITH THIS CHANGE OR ADDITIONAL PERMISSIONS THAT WEREN'T ALLOWED PREVIOUSLY. UM, AND THEN NO DIRECT PHYSICAL CHANGE TO THE ENVIRONMENT. IT'S JUST MERELY A, UH, DIFFERENT WAY OF DEFINING WHAT HEIGHT IS IN THE CITY. SO IN SUMMARY, UM, STAFF RECOMMENDED TO THE COMMISSION TO SUPPORT THE AMENDMENT. UH, PLANNING COMMISSION DID RECOMMEND ADOPTION OF THIS AMENDMENT TO CITY COUNCIL. IT IS A RELATIVELY MINOR CHANGE IN SCOPE AND IT ALLOWS FOR FLEXIBILITY, UH, FOR A LOT TO, UH, RECEIVE THEIR DEVELOPMENT POTENTIAL AS WELL AS A PRO POTENTIAL REDUCTION ON CONSTRUCTION COST. UM, SO WITH THIS PUBLIC HEARING, UH, COUNCIL HAS THE ABILITY TO ADOPT THIS CHANGE, UH, AND TODAY, UH, ADOPT THE, INTRODUCE THE AMENDMENT TO SECTION 18 POINT 10.060 OF TITLE 18 OF THE MUNICIPAL CODE.
