SO THE AREA'S DIRECTLY SERVED, SERVED BY A TRANSIT ROUTE.
UM, THE PROPERTIES TO THE SOUTH ACROSS, UH, THE EAST SEVENTH STREET, 17TH STREET RIGHT AWAY ARE ALL CURRENTLY ZONED MX C ONE ALONG EAST 18TH STREET, UM, WHICH IS DIRECTLY ABUTTING THE REQUESTED AREA.
SO THE APPLICANT INTENDS TO CONSTRUCT A FIVE UNIT MULTIFAMILY DWELLING.
UH, THIS IS NOT PERMITTED IN THE RS TWO, WHICH ONLY ALLOWS ONE SINGLE FAMILY UNIT PER LOT.
UM, THEIR COURT REQUEST WAS TO CHANGE THE ZONING TO MX C ONE, WHICH WAS INITIATED BY PLANNING COMMISSION NOVEMBER 18TH.
UM, WHEN YOU CHANGE THE ZONING, YOU ALSO ALSO HAVE TO KEEP THE LAND USE DESIGNATION WITH THE GENERAL PLAN CONSISTENT.
SO IT'S ALSO A GENERAL PLAN AMENDMENT, UH, WHICH WILL GO FROM LOW MEDIUM DENSITY RESIDENTIAL TO MEDIUM MIXED USE, UH, LAND USE DESIGNATION.
UM, THE NEIGHBORING PROPERTIES ARE INCLUDED IN THE REQUEST.
UM, ALL THESE PROPERTIES ARE CURRENTLY CONSIDERED LEGAL NON-CONFORMING LEGAL, AS IN THEY WERE BUILT TO THE STANDARDS OF THE DAY NONCONFORMING AS THEY DON'T MEET TODAY'S CURRENT STANDARDS OF THE RSS TWO ZONE.
SO HERE'S THE APPLICANT'S CONCEPT.
UM, THEY HAVE A PROPOSED TWO STORY FIVE UNIT RESIDENTIAL BUILDING, UH, BASICALLY LEAVING THE BACK END BLANK, UM, AND HAVING PARKING IN THEIR, WE WERE SERVED BY A TWO-WAY DRIVEWAY.
SO THE CONCEPT WAS MODIFIED FROM WHAT THE APPLICANT ORIGINALLY INTENDED TO DO.
IT WAS REDUCED FROM THREE STORIES IN HEIGHT TO TWO STORIES AND SEVEN UNITS DOWN TO FIVE UNITS.
THIS WAS THE RESULT OF FIRE DEPARTMENT COMMENTS AND FIRE DEPARTMENT REQUIREMENTS.
SO, UM, THE BUILDING IS REALLY AS LARGE AS THAT SITE CAN HANDLE WHILE STILL MEETING FIRE CODE.
HERE'S AN OUTLINE OF THE PROPOSED REZONING.
SO EVERYTHING IN THE HASHED AREA WOULD MAKE THAT CHANGE FROM THE RED ZONE ON THE BOTTOM, M OR I'M SORRY, THE YELLOW ZONE ON THE TOP, RS TWO TO THE RED ZONE ON THE BOTTOM, MXC ONE, WHICH WOULD EXTEND THAT EXISTING DISTRICT.
UM, SO FOR STAFF, UH, THE SURROUNDING AREA, TAKING A LOOK AT THE AREA, UH, IT'S ALMOST ENTIRELY SINGLE FAMILY RESIDENTIAL.
UM, IT'S PRETTY LOW DENSITY IN THIS PART OF TOWN IS FURTHER EAST.
UH, THE TYPICAL DENSITY OF THE SINGLE FAMILY USES OUT THERE RANGE FROM 2.5 TO 5.3 DWELLING USE PER ACRE.
UM, THIS INCLUDES BOTH THE RS TWO ZONE AND THE ZONE PROPERTIES ALREADY ZONED MX C ONE.
UM, THE CURRENT GENERAL PLAN LAND USE DESIGNATION OUT THERE ALLOWS UP TO NINE DWELLING USE PER ACRE.
SO THIS PART OF NATIONAL CITY IS, UH, PRETTY UNDERUTILIZED AS FAR AS THE AMOUNT OF DENSITY IT COULD SUPPORT.
UM, COMMERCIAL PROPERTIES ARE ALSO VERY LIMITED IN THE AREA.
UM, THERE ARE TWO LOCATED IN THE PROPOSAL WHICH WOULD BECOME CONFORMING TO THE ZONING.
UM, AND THEN THERE WOULD BE A, THIS ONE SMALL OFFICE BUILDING AT THE CORNER OF 16TH AND RACHEL.
AND THEN WAY ON THE OTHER SIDE OF

THIS BLOCK, THERE'S ALSO A LIQUOR STORE AT SOUTH ANOINTING AND EAST 18TH STREET.SO OVERALL, THE AREA DOESN'T HAVE, UH, MANY COMMERCIAL USES THAT ARE EXISTING.
THERE ARE VERY FEW MULTI OR THERE ARE FEW MULTI-UNIT RESIDENTIAL PROPERTIES.
UM, MOST OF THEM ARE INTO THE SOUTH WITHIN THAT MXC ONE ZONE.
UM, THERE ARE SEVERAL PROPERTIES WITH THREE OR MORE UNITS.
UM, WHILE THE MX C ONE ZONE ALLOWS FOR UP TO 48 DWELLING UNITS PER ACRE, WHAT'S CURRENTLY BUILT OUT THERE IS LESS DENSE THAN THAT, THAN THAT.
SO THE LARGEST APARTMENT BUILDING HAS A DENSITY OF, UH, 29 DWELLING UNITS PER ACRE, WHICH IS BELOW GENERAL PLANT DENSITY.
UM, THE TWO MULTI-FAMILY PROPERTIES WITHIN THE REZONE ARE AT 14 AND 15 DWELLING UNITS PER ACRE.
AGAIN, THAT'S WELL BELOW THE DENSITY OF THE REQUESTED MX C ONE ZONE.
UM, MOVING ON TO THE GENERAL PLAN, UM, STEPH LOOKED AT OUR GENERAL PLAN POLICIES AND THERE ARE FOR THAT ARE RELATED TO THIS REQUEST.
SO IN OUR HOUSING ELEMENT, UH, POLICY, H 1.1 PROVIDE AN ADEQUATE SUPPLY OF LAND ZONE FOR RESIDENTIAL DEVELOPMENT TO MEET PROJECTING HOUSING NEED.
UM, 2.1, PROMOTE RESIDENTIAL DEVELOPMENT ON UNDERUTILIZED LAND AND REMOVE BARRIERS TO INFO DEVELOPMENT, UH, IN THE LAND USE ELEMENT OF THE GENERAL PLAN.
LU 2.1 FACILITATE THE DEVELOPMENT OF A VARIETY OF HOUSING TYPES TO MEET THE REGIONAL HOUSING NEEDS ASSESSMENT ALLOCATIONS WHILE ENHANCING THE CITY'S COMMUNITY CHARACTER AND LAND USE 3.1 SUPPORT THE CREATION AND EXPANSION OF MIXED USE COMMERCIAL AND HIGHER DENSITY RESIDENTIAL DEVELOPMENT IN TRANSIT PRIORITY AREAS AND ALONG MIXED USE CORRIDORS.
SO THE APPLICANT'S PROPERTY IS CURRENTLY VACANT AND IT LACKS THE NECESSARY FRONTAGE TO DEVELOP A SUBDIVISION, UH, WHICH WOULD LEAD TO, UH, EITHER GOING UNDER UNDEVELOPED OR UNDERUTILIZED IF IT WERE TO BE DEVELOPED UNDER RS TWO.
UH, THE PROPOSAL ALSO PROMOTES AND CONTRIBUTES TO THE VIABILITY OF THE MX C ONE DISTRICT ALREADY ESTABLISHED ALONG EAST 18TH STREET, UM, BECAUSE IT'S ALLOWING THAT ZONE TO EXPAND IN AN AREA THAT'S SERVED BY PUBLIC TRANSIT.
UM, SO IT'S IMPROVING THE VIABILITY OF THAT DISTRICT, UM, FOR THE LAND USE CODE.
UH, THIS PROJECT IS STILL, THE MULTIFAMILY PORTION OF THE PROJECT IS STILL CONCEPTUAL AT THIS STAGE.
UM, BUT BASED ON WHAT HAS BEEN SUBMITTED TO STAFF AS FAR AS THE SITE PLAN, UM, IT LOOKS LIKE IT CAN CONFORM TO DEVELOPMENT STANDARDS RELATED TO THE PROPOSED ZONE.
UH, HOWEVER, WE HAVE IDENTIFIED THE 75% STREET WALL REQUIREMENT AS SOMETHING THAT THE APPLICANT WOULD NOT BE ABLE TO MEET.
UM, SO THAT'S WHERE THE APPLICANT OPTED TO REQUEST FOR A ZONE VARIANCE TO ALLOW PROPERTY TO, UH, INCLUDE A TWO-WAY DRIVEWAY IN THE PROPOSED DEVELOPMENT.
UH, UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT.
UM, INITIAL STUDY CHECKLIST WAS PREPARED FOR BOTH THE GENERAL PLAN AND ZONE CHANGE AMENDMENTS.
UM, SAF IS RECOMMENDING CERTIFICATION OF A NEGATIVE DECLARATION BASED ON THE RESULTS OF THAT INITIAL STUDY CHECKLIST.
UM, THE REQUESTED ZONE VARIANCE WAS NOT REALLY TALKED ABOUT IN THAT INITIAL STUDY.
SO STAFF IS RECOMMENDING A CATEGORICAL EXEMPTION, UH, CLASS 32 INFO DEVELOPMENT FOR THE ZONE VARIANCE PART OF THE PROJECT.
UM, AND THEN LIKE I MENTIONED AT THE VERY BEGINNING, UM, ITEMS ARE TO BE CONSIDERED UNDER TWO SEPARATE RESOLUTIONS.
ONE FOR THE GENERAL PLA, THE CERTIFICATION OF THE NEGATIVE DECLARATION, THE GENERAL PLAN AMENDMENT AND ZONE CHANGE, AND THEN A SECOND, UM, RESOLUTION FOR JUST THE ZONE VARIANCE AND THE DETERMINATION OF THE CATEGORICAL EXEMPTION.
SO IN SUMMARY, IN SUMMARY, THE APPLICANT'S PROPERTY IS CURRENTLY VACANT AND SUITABLE FOR INFILL DEVELOPMENT.

THIS PROJECT IS DESIGNED TO FIT NATURALLY IN THE NEIGHBORHOOD BETWEEN A SINGLE FAMILY HOME ON ONE SIDE AND MULTI-UNIT FAMILY HOUSING ON THE OTHER.
THIS REZONE IS ESPECIALLY IMPORTANT BECAUSE OF THE CITYWIDE REZONED IN 2011.
AT THAT TIME, SEVERAL OF THESE PROPERTIES ON OUR BLOCK, INCLUDING THE TWO MULTI-UNIT COMPLEXES, A PRESCHOOL AND A LIQUOR STORE, WERE REZONED INTO RS TWO SINGLE FAMILY ZONING.
EVEN THOUGH THEY WERE ALREADY MULTI-FAMILY OR COMMERCIAL USE TODAY, THOSE PROPERTIES REMAINED LEGALLY NON-COMPLIANT WITH CITY ZONING.
WHAT THIS MEANS IS IF A DISASTER WERE TO STRIKE, SAY, A FIRE OR AN EARTHQUAKE, THOSE BUSINESSES OR AND MULTIFAMILY UNITS WOULD NOT BE PERMITTED TO REBUILD TO THEIR ORIGINAL STATE UNDER THE CURRENT ZONING.
BY APPROVING THIS REZ, YOU ARE NOT ONLY ALLOWING OUR PROJECT TO MOVE FORWARD, BUT YOU'RE ALSO RESTORING FAIRNESS, CONSISTENCY, AND LONG-TERM STABILITY ACROSS THE BLOCK.

DENSITY IS AN ISSUE, YOU KNOW, SO THE APPLICANT IS PROPOSING, UM, IT LOOKS LIKE THEY MIGHT BE PROPOSING SIX PARKING SPACES AND THEY CAN SPEAK TO THAT IF YOU HAVE MORE QUESTIONS ABOUT, UM, WHAT THEY ARE PROVIDING ON SITE.

THEY INCLUDE MINIMUM AND MAXIMUM STANDARDS INCLUDING SETBACKS, HEIGHT, FLOOR, AREA, AND DENSITY.
CURRENTLY THE MAXIMUM HEIGHT LISTED IN THE TABLES IS 50 FEET AND THREE STORIES.

ADDITIONALLY, THERE ARE OTHER DEVELOPMENT STANDARDS THAT ALREADY LIMIT THE SIZE AND BULK OF BUILDINGS IN THE MX C ONE AND MXD ONE ZONES.
THE MAXIMUM HEIGHT OF A BUILDING IS 50 FEET.
THE MAXIMUM FLOOR AREA RATIO IS 1.0 FOR SINGLE USE PROJECTS AND 2.0 FOR MIXED USE PROJECTS.
THERE'S A MAXIMUM DENSITY OF 48 DWELLING UNITS PER ACRE.
AND THEN THERE'S ALSO MINIMUM STEP BACKS.

ADDITIONALLY, STAFF HAS RECOMMENDED AN INCREASE IN THE MAXIMUM NUMBER OF STORIES PERMITTED IN THE MXD ONE ZONE TO ALLOW FOR FOUR STORIES.
SINCE IT HAS THE SAME DEVELOPMENT STANDARDS AS THE MXC ONE ZONE, THERE ARE CURRENTLY NO PROPOSED CHANGES TO THE MAXIMUM HEIGHT IN FEET, THE FLOOR AREA OR DENSITY.
AND THEN JUST AS A REMINDER, THIS PROPOSAL WAS INITIATED BY PLANNING COMMISSION AT THE JULY 21ST, 2025 MEETING.
SO HERE YOU CAN SEE THE PORTIONS OF THE TABLES THAT WOULD BE CHANGED.
SO CURRENTLY THE MAXIMUM IS 50 FEET AND THREE STORIES.
AND THEN STAFF IS SUGGESTING THE FOLLOWING CHANGES.

UM, AND THEN THE M XT ONE ZONE ENCOMPASSES MORE PORTIONS THROUGHOUT THE CITY, UM, INCLUDING PORTIONS OF HIGHLAND EAST FOURTH, EAST EIGHTH, EAST 18TH, 24TH STREET AND 30TH.
AND THEN I ALSO WANTED TO INCLUDE A LITTLE INFOGRAPHIC TO SHOW YOU WHAT THAT CHANGE WOULD LOOK LIKE.
SO CURRENTLY WE ALLOW FOR 50 FEET AND THREE STORIES, WHICH IS THE LITTLE PICTURE ON THE LEFT.
UM, AND THEN STAFF IS PROPOSING THE 50 FEET AND FOUR STORIES.
SO THE INTENT OF THE MX C ONE AND MX D ONE ZONES IS IN IS TO ENSURE EXCELLENT INSIGHT PLANNING AND BUILDING DESIGN TO CREATE VIBRANT AND WELL-DEFINED PUBLIC REALM THAT IS PEDESTRIAN FRIENDLY AND SUPPORTIVE OF THE SUSTAINABLE WAY OF LIFE.
INCREASING THE NUMBER OF PERMITTED STORIES FROM THREE TO FOUR IS IN LINE WITH THE INTENT OF THE ZONES.
BY PROVIDING GREATER SITE DESIGN FLEXIBILITY, IT GIVES PROJECTS THE ABILITY TO BUILD UP INSTEAD OF OUT CREATING NEW SPACE THAT CAN BE UTILIZED FOR THE BENEFIT OF THE RESIDENTS LIKE GREEN SPACE, CALM AND OPEN SPACE AND PARKING.
THE CURRENT HEIGHT REQUIREMENTS IN THE MX C ONE AND MX C ONE ZONES PROVIDE FOR A MAXIMUM HEIGHT THAT WOULD NEVER BE ACHIEVED BY CONVENTIONAL BUILDING DESIGNS.
THE LARGE GAP BETWEEN HEIGHT AND FEE AND THE NUMBER OF STORIES PERMITTED IS AN UNNECESSARY BURDEN TO NEW DEVELOPMENTS.
AND IT ALSO CONFLICTS WITH GENERAL PLAN POLICIES RELATED TO INFILL DEVELOPMENT.
BECAUSE IT DOESN'T ALLOW FOR FLEXIBLE SITE DESIGN AND DETERS PROJECT ON SMALLER OR SLOPED LOTS, THIS AMENDMENT WOULD IMPROVE CONSISTENCY WITH OTHER ZONES THROUGHOUT THE CITY.
AGAIN, OUR MIXED USE TRANSITION ZONE, WHICH WAS INTENDED TO BE A TRANSITION TO A LOWER DENSITY RESIDENTIAL ZONES, ALLOWS FOR UP TO FOUR STORIES EVEN THOUGH IT HAS A LESSER MAXIMUM HEIGHT OF 45 FEET.
SINCE THE MX C ONE AND MXD ONE ZONES ALREADY ALLOW 50 FEET IN HEIGHT, INCREASING THE NUMBER OF PERMITTED STORIES TO FOUR STORIES IS NOT EXPECTED TO BE ANY MORE IMPACTFUL.
ADDITIONALLY, THERE ARE NO PROPOSED CHANGES TO THE MAXIMUM HEIGHT IN FEET FLOOR AREA OR DENSITY.
SO THERE'S NO INCREASE TO THE AMOUNT OF BUILDING AREA BEING GRANTED.
AND ALL PROJECTS WITHIN THE ZONES ARE REQUIRED TO MEET THOSE DEVELOPMENT STANDARDS.
SO THERE'S TWO FINDINGS REQUIRED FOR CODE AMENDMENTS.
THE FIRST IS CONSISTENCY WITH THE GENERAL PLAN.
THIS PROPOSAL IS CONSISTENT WITH GENERAL PLAN POLICIES, SPECIFICALLY HOUSING POLICY 2.1, WHICH PROMOTES RESIDENTIAL DEVELOPMENT ON UNDERUTILIZED LAND AND REMOVE BARRIERS TO INFILL DEVELOPMENT.
AND IT'S ALSO CONSISTENT WITH LAND USE POLICY 5.4, WHICH ENCOURAGES AND INCENTIVIZE STRATEGIC ADAPTIVE REUSE AND INFILL DEVELOPMENT ON VACANT LAND IN COMMERCIAL AND MIXED USE AREAS.
THE SECOND FINDING IS COMPLIANCE WITH THE CALIFORNIA ENVIRONMENTAL QUALITY ACT.
UM, THE ORDINANCE BEING PROPOSED IS CONSIDERED EXEMPT FROM CQA BECAUSE IT IS NOT A PROJECT AS DEFINED IN SECTION 15 378 SINCE THERE'S NO INCREASE IN DENSITY, HEIGHT, OR OTHER PERMISSIONS.
SO THEREFORE THERE'S NO POTENTIAL FOR A RESULT.
THERE'S NO POTENTIAL TO RESULT IN EITHER A DIRECT PHYSICAL CHANGE OF THE ENVIRONMENT OR ANY REASONABLY FORESEEABLE INDIRECT PHYSICAL CHANGE IN THE ENVIRONMENT.
SO THE OPTIONS TONIGHT ARE RECOMMENDED THAT THE CITY COUNCIL INTRODUCE AND ADOPT THE AMENDMENTS TO THE TABLES OF THE LAND USE CODE BASED ON THE ATTACHED FINDINGS.
OR RECOMMEND THAT CITY COUNCIL NOT AMEND THE TABLES IN THE LAND USE CODES, LAND USE CODES BASED ON THE FINDINGS, OR CONTINUE THE ITEM TO A SPECIFIC DATE AND PROVIDE DIRECTION.

IF THEY REALLY HAVE A STRONG OPINION AND THEIR COMMUNITY'S OPPOSED TO IT, THEN THE CITY COUNCIL MEMBER AS POLICY MAKERS, WE ARE NOT POLICY MAKERS.
WE ARE TRYING TO ENFORCE AND ABIDE BY THE LABOR CO I MEAN, SORRY, THE, THE LAND CODE, THE MUNICIPAL CODE, THE GENERAL, I MEAN, WE ARE NOT POLICYMAKERS.

UH, THE APPLICANT WENT THROUGH THE PROCESS, THE PROJECT WENT THROUGH THE PROCESS, UH, IT WAS APPROVED.
UH, THEY SUBMITTED BUILDING PLANS.
THE BUILDING PERMITS WERE APPROVED AND THEY WENT OUT BROKE GROUND, AND ALL OF A SUDDEN, ALL HELL BREAKS LOOSE BECAUSE THE PUBLIC IS OPPOSED TO THIS PROJECT.
AND MY ONLY RESPONSE TO THOSE PEOPLE WHO CAME TO THE FRONT COUNTER WAS, WHERE WERE YOU WHEN THE PUBLIC NOTICES WENT OUT AND YOU HAD A CHANCE TO ACTUALLY REVIEW THIS PROJECT IN DETAIL AND COME TO THE PUBLIC HEARINGS? IT WENT THROUGH THE PROCESS.
SO NOW IT'S NOT THE TIME, UH, TO PUT THE APPLICANT IN DOUBLE JEOPARDY.
UH, THE PROJECT WENT THROUGH THE PROCESS, THE BUILDING PERMITS WERE ISSUED, THE PLANS WERE FINE.
EVERYTHING HAS GONE THROUGH THE PROPER PROCESS ACCORDING TO STATE LAW.
SO, UM, I HOPE THAT CLARIFIES SOME OF THE CONCERNS HERE TONIGHT ABOUT THAT.
UM, BECAUSE THE, THE PROCESS, UH, AS HAS BEEN MENTIONED BEFORE IS VERY MUCH THE SAME THROUGHOUT THE STATE OF CALIFORNIA.
