UM, THEY'RE PROPOSING TO SELL ALCOHOL FROM 7:00 AM TO 10:00 PM DAILY.

MANOLA ALREADY HAS 408 SQUARE FEET OF FLOOR AREA DEDICATED TO THE EXISTING BEER AND WINE, AND THEY'RE PROPOSING AN ADDITIONAL 64 SQUARE FEET FOR THE PROPOSED DISTILLED SPIRITS, WHICH WILL BE LOCATED BEHIND THE SALES COUNTER.

THIS IS AN OVERVIEW OF THE FLOOR PLAN.

THE EXIT ALONG THE TOP IS LOCATED CLOSEST TO HIGHLAND AVENUE, AND THEN THE MAIN ENTRANCE IS

SO MOVING ON TO STAFF'S ANALYSIS, THE CODE ALLOWS FOR ALCOHOL SALES FOR OFFSITE CONSUMPTION IN THE MXC ONE ZONE WITH AN APPROVED CUP.

THERE'S ALSO ADDITIONAL REQUIREMENTS RELATED TO ALCOHOL CUBS, WHICH INCLUDES EXPANDED MAILING FOR ALL OWNERS AND OCCUPANTS WITHIN 660 FEET OF THE SITE.

THE APPLICANT IS ALSO REQUIRED TO HOLD A COMMUNITY MEETING, WHICH THEY HELD ON JULY 8TH.

THERE WERE NO ATTENDEES.

THERE'S ALSO ADDITIONAL DISTANCE REQUIREMENTS FOR ALCOHOL CS, BUT THEY'RE NOT APPLICABLE TO GROCERY STORES.

THE SITE IS LOCATED IN CENSUS TRACT ONE 18.02, WHERE THERE ARE CURRENTLY FOUR OFF SALE LICENSES AND A TOTAL OF FOUR ARE RECOMMENDED BY A BC.

BUT THE APPLICANT IS ALREADY ONE OF THE FOUR EXISTING LICENSES, SO NO ADDITIONAL LICENSES WILL BE ADDED TO THAT CENSUS TRACT.

THE PROJECT WILL ALSO ADHERE TO CITY COUNCIL POLICY 7 0 7, WHICH WE ADDRESSED WITH STANDARD CONDITIONS OF APPROVAL AND STAFF HAS DETERMINED THAT THE PROJECT IS EXEMPT FROM CQA CLASS ONE EXISTING FACILITIES.

WE RECEIVED COMMENTS FROM THE POLICE DEPARTMENT.

THEY PROVIDED A RISK ASSESSMENT, WHICH GAVE THE PROJECT 11 POINTS.

ANYTHING BELOW 12 IS CONSIDERED LOW RISK.

WE ALSO RECEIVED COMMENTS FROM THE INSTITUTE FOR PUBLIC STRATEGIES THEY RECOMMENDED IN-PERSON RESPONSIBLE BEVERAGE TRAINING, DAILY REMOVAL OF LITTER AND GRAFFITI SIGNAGE RELATED TO THE SALE OF ALCOHOL TO PEOPLE UNDER THE AGES OF 21, AND SIGNS PROHIBITING OPEN CONTAINERS AND LOITERING ON THE PREMISES.

THESE CONDITION, OR SORRY, THESE RECOMMENDATIONS WERE INCORPORATED INTO THE CONDITIONS OF APPROVAL.

STAFF IS RECOMMENDED STANDARD CONDITIONS OF APPROVAL, WHICH INCLUDES CONDITIONS SPECIFIC TO OFFSITE ALCOHOL SALES PER CITY COUNCIL POLICY 7 0 7.

THOSE INCLUDE HOURS OF OPERATION, RESPONSIBLE BEVERAGE TRAINING AND ACCESSORY ALCOHOL SALES.

WE ALSO INCLUDED APPLICATION SPECIFIC CONDITIONS, INCLUDING THE APP.

THE APPLICANT WILL MAINTAIN THE CONDITIONS OF THE EXISTING COP FROM 2000.

WE INCLUDED IPSS COMMENTS RELATED TO SIGNAGE, GRAFFITI, AND LITTER.

AND STAFF ALSO INCLUDED A CONDITION STATING THAT THE DISTILLED SPIRITS WILL BE STORED IN A LOCKABLE CABINET BEHIND THE SALES COUNTER.

AS YOU CAN SEE FROM THE FLOOR PLAN, THE PROPOSED LOCATION OF THE DISTILLED SPIRITS IS LOCATED PRETTY CLOSE TO THE MAIN ENTRANCE AND EXIT.

SO THAT'S WHY STAFF INCLUDED THAT ADDITIONAL CONDITION.

IN SUMMARY, THE PROPOSED USE IS CONSISTENT WITH THE GENERAL PLAN.

ALCOHOL SALES FOR OFFSITE CONSUMPTION ARE A CONDITIONALLY ALLOWED USE IN THE MXC ONE ZONE.

ALCOHOL SALES WILL REMAIN ACCESSORY TO THE GROCERY STORE, WHICH IS AN AN ALREADY ESTABLISHED COMMERCIAL AREA.

THERE'S ALREADY THE INCLUSION OF CONDITIONS CONSISTENT WITH CITY COUNCIL POLICY 7 0 7, WHICH ARE INTENDED TO ALLEVIATE ANY CONCERNS RELATED TO IMPACTS ON THE AREA.

AND WE ALSO ADDRESSED IPSS COMMENTS IN THE CONDITIONS.

MANY CHILDREN KNOW NOT TO COME IN AND PURCHASE LIQUOR BECAUSE THEY KNOW MY HUSBAND KNOWS THEM AND THEIR PARENTS.

UM, AND HE'S VERY DILIGENT ABOUT NOT SELLING TO MINORS.

IT'S ONE OF, YOU KNOW, ONE OF HIS BIG THINGS THAT HE STANDS BEHIND.

UH, EXCEPTIONS CAN BE GRANTED FROM TITLE 17.

IF A PROPERTY HAS SUCH A SIZE, SHAPE, OR TOPOGRAPHIC CONDITION THAT MAKES IT IMPOSSIBLE OR IMPRACTICAL TO FULLY CONFORM TO THE SUBDIVISION REQUIREMENTS, UH, AND THAT THE EXCEPTION WILL NOT BE DETRIMENTAL TO PUBLIC HEALTH, SAFETY, WELFARE OR BE DETRI DETRIMENTAL TO THE USE OF OTHER PROPERTIES IN THE VICINITY.

AND THEN THAT THE GRANTING OF THE EXCEPTION, UH, IS CONSISTENT WITH THE GENERAL PLAN AND ALL APPLICABLE, SPECIFIC PLANS OR OTHER PLANS OF THE CITY.

SO IN THIS CASE, THE LOT IS 85 FEET WIDE AND THERE'S SIMPLY NO WAY TO, UH, DIVIDE THIS AND MEET MINIMUM FRONTAGE FOR TWO LOTS.

SO THERE'S THE IMPOSSIBILITY OF IT BASED ON THE SHAPE.

UM, BUT I WOULD ALSO ADD THE TOPOGRAPHY OF THE SITE WOULD ALSO MAKE IT TO DEVELOP IN CERTAIN LOCATIONS.

SO THE SLOPES GET PRETTY STEEP ON CERTAIN PORTIONS OF THIS LOT.

UH, SO THE FLAG LOT KIND OF PUTS THE DRIVEWAY WHERE IT'S STEEPEST, WHICH MAKES IT, UM, EASIER TO DEVELOP.

SO THE COMBINATION OF THE TWO, UH, THE WIDTH OF THE LOT AND THE TOPOGRAPHY, UH, ARE THE KIND OF UNIQUE SITUATIONS THAT WOULD MAKE RENTING EXCEPTION, UH, SOMETHING THAT COULD BE CONSIDERED.

UM, THE PROJECT IS ALSO CONDITIONED TO MEET ALL APPLICABLE DEVELOPMENT STANDARDS.

SO TALKING ABOUT PUBLIC HEALTH, WELFARE SAFETY, UH, THAT WOULD INCLUDE THINGS LIKE THEY HAVE TO GET A SEWER PERMIT TO CONNECT TO THE SEWER SYSTEM, ET CETERA.

UM, AND THEN THE PROJECT IS CONSISTENT WITH THE GENERAL PLAN MEETS DENSITY, UH, AS MENTIONED BEFORE, AND IT'S ALSO NOT LOCATED IN ANY SPECIFIC PLAN.

CONTINUING WITH CONSISTENCY WITH THE LAND USE CODE, UM, THE RS TWO ZONE HAS A REAR YARD SETBACK OF 25 FEET.

IN THIS CASE, THE APPLICANT IS REQUESTING A VARIANCE.

UM, SO A VARIANCE CAN BE REQUESTED OR GRANTED ONLY BECAUSE THERE ARE SPECIAL CIRCUMSTANCES APPLICABLE TO THE PROPERTY SUCH AS SIZE SHAPED TOPOGRAPHY, LOCATION, OR SURROUNDINGS, THAT THE STRIPPED APPLICATION OF THE DEVELOPMENT STANDARDS WOULD DEPRIVE THE PROPERTY, UH, OF THE PRIVILEGES ENJOYED BY OTHER PROPERTY IN THE VICINITY AND UNDER IDENT IDENTICAL ZONING CLASSIFICATION.

UH, THE SECOND FINDING FOR VARIANCE IS THAT IT SHALL NOT BE GRANTING A SPECIAL PRIVILEGE INCONSISTENT WITH THE LIMITATION ON ALL THEIR PROPERTIES IN THE SAME VICINITY AND ZONE, AND THAT THE ZONE VARIANCE SHALL NOT BE GRANTED FOR A USE OR ACTIVITY NOT AUTHORIZED IN THE ZONE.

SO LOOKING AT IT, THE SUBJECT PROPERTY HAS A SIZE AND SHAPE THAT IS INSUFFICIENT FOR CONFORMANCE WITH ALL SETBACK REQUIREMENTS FOR THE TWO PROPOSED PARCELS.

SO IT DOES LACK SUFFICIENT WIDTH TO CREATE 235 FOOT DEEP PARCELS.

SO BASICALLY, IF YOU SPLIT DOWN THE MIDDLE AND GO BACK, UM, IT DOESN'T HAVE THE WIDTH TO DO THAT AND MAINTAIN THE SUBDIVISION ORDINANCE.

UH, AND THEN THE TOPOGRAPHY WOULD ALSO HAVE MADE THIS CONFIGURATION LESS PRACTICAL.

AS I MENTIONED, THERE ARE CERTAIN POINTS IN THE LOT WHERE IT GETS PRETTY STEEP.

UM, SO THE CONFIGURATION WITH ONE PROPERTY IN FRONT OF THE OTHER, UH,

WITH ONE IN THE FRONT, ONE IN THE REAR LEADS TO OVERLY RESTRICTIVE SETBACK REQUIREMENTS.

SO THE APPLICANT'S PROPOSING TO HAVE A DRIVEWAY LEADING TO A, A PARCEL IN THE BACK.

AND SO WITH THAT FRONT BACK CONFIGURATION OF LOTS, IF YOU TAKE YOUR FRONT YARD SETBACK, REAR YARD SETBACK, FRONT YARD SETBACK, REAR YARD SETBACK, ALL THAT WOULD BE LEFT IS 60 FEET OF BUILDABLE AREA TO BE SPLIT BETWEEN THE TWO NEW LOTS, WHICH IS NOT A LOT OF ROOM.

UM, SO THE REQUEST IS FOR A 10 FOOT REAR YARD SETBACK FOR PARCEL ONE AND SEVEN FOOT REAR YARD SETBACK FOR PARCEL TWO.

UH, AND THAT WOULD GRANT NECESSARY RELIEF TO PROVIDE PRACTICAL DEVELOPMENT SITES.

UM, THERE ARE OTHER SITES ALONG EAST SEVENTH STREET THAT HAVE REDUCED SETBACKS.

SO SOME OF THE NEIGHBORING PROPERTIES ARE CURRENTLY LESS THAN 25, UH, FEET, REAR YARD SETBACKS.

UM, AND THE USE HAS PROPOSED A SINGLE FAMILY, WHICH IS CONSISTENT WITH ITS OWN.

THOSE ARE THE OTHER TWO FINDINGS FOR VARIANCES.

UM, GOING BACK TO THE IMAGE WITH THE SETBACKS, UM, LET'S SEE.

DO I HAVE THE THING? YEAH.

SO IF YOU LOOK AT PARCEL ONE, THE 20 FOOT SETBACK IN THE FRONT, SETBACK IN THE FRONT IS OKAY.

UH, THIS WOULD BE CONSIDERED A SIDE YARD SETBACK HERE, SO THAT'S OKAY, BUT THEN WHEN YOU GET TO THE BACK, UM, THERE'S SIMPLY NOT ENOUGH ROOM TO MAKE 25 FOOT YARDS, 25 FOOT SETBACK IN THE BACK.

UM, AND THEN SAME THING WITH THE FRONT, THE EXISTING HOUSE AND WHERE THEY'VE CHOSEN TO, UH, SHOW THE LOT LINE HERE, IT WOULD ONLY BE SEVEN FEET, WHICH WOULD NOT NOT MEET THE 25 FOOT YARD SETBACK FOR THE FRONT.

SO WHEN YOU STACK THE SETBACKS TOGETHER, 20 FEET IN THE FRONT FOR PARCEL 2 25 IN THE BACK FOR PARCEL, TWO, FIVE FEET FOR PARCEL, ONE, HAVE A DEVELOPMENT SITE, AND THEN ANOTHER 25 FEET THERE JUST SIMPLY ISN'T ENOUGH ROOM FOR PRACTICAL DEVELOPMENT.

UM, UNDER CALIFORNIA ENVIRONMENTAL QUALITY ACT, UM, STAFF WOULD DE RECOMMEND DETERMINING THAT IT'S EXEMPT FOR CLASS 32, WHICH IS THE INFILL DEVELOPMENT PROJECT, UH, SITES UNDER FIVE ACRES THAT ARE, YOU KNOW, URBAN IN THE SURROUNDINGS, UM, GETTING TWO, UH, CONDITIONS OF APPROVAL.

UM, WE'VE INCORPORATED THEIR COMMENTS FROM ENGINEERING FIRE.

UH, THESE ARE BASICALLY, UH, STANDARD CONDITIONS RELATED TO NEW DEVELOPMENTS, UM, HAPPENING IN THE CITY.

UH, BECAUSE THAT HATE FOR US TO CREATE A LAKE HERE WITH THESE RETAINING WALLS.
