THE, UH, CHARACTERISTICS OF THE SITE, UM, THIS IS LOCATED ON EAST FOURTH STREET BETWEEN I 8 0 5 AND T AVENUE. UM, IT IS IN THE RS TWO SMALL LOT RESIDENTIAL ZONE. IT IS A, UH, 2,285 SQUARE FOOT VACANT PARCEL. UM, IT HAS A TRIANGULAR SHAPE AND IT, UH, FOR ALL PURPOSES APPEARS TO BE A REMNANT PARCEL FROM WHEN THE HIGHWAY WAS CONSTRUCTED. UH, THE LOT DOES HAVE 50 FEET OF STREET FRONTAGE AND, UM, IT WOULD BE CONSIDERED SUBSTANDARD IN SIZE AND SHAPE AND HAS A, UH, ESSENTIALLY A CONSTRAINED BUILDABLE AREA, UH, SURROUNDING THE SITE. SO THE PROPOSAL IS, UH, REQUESTING ESSENTIALLY SEVERAL VARIANCES TO CONSTRUCT A NEW SINGLE FAMILY RESIDENCE. UH, THE SIZE OF THE PROPOSED RESIDENCE IS 1,757 SQUARE FEET. IT WOULD INCLUDE ONE, UH, OR AN ATTACHED ONE CAR GARAGE. IT WOULD BE THREE STORIES IN HEIGHT WITH THE UPPER LEVEL BEING 534 SQUARE FEET. I'LL TALK ABOUT THAT LATER. UM, THE APPLICANT IS REQUESTING A COUPLE REDUCED SETBACKS, UH, AS WELL AS THE ABILITY TO PARK WITHIN THE FRONT YARD SETBACK. THERE IS NO REQUEST FOR EITHER AN ACCESSORY DWELLING UNIT OR ADDITIONAL UNIT UNDER SENATE BILL NINE, UH, BEFORE YOU TODAY AS WELL. SO JUST A SINGLE FAMILY HOME. HERE'S, UH, THE SITE PLAN, AS YOU CAN SEE THE SHAPE AND KIND OF HOW THE APPLICANT INTENDS TO LOCATE THE HOME. AND I KIND OF DREW THE DIFFERENT VARIANTS, UH, PER PROPOSALS INTO THE PLANT. SO YOU CAN TAKE A BETTER LOOK AT WHAT'S HAPPENING. SO FIRST OF ALL, IT IS BELOW THE MINIMUM LOT SIZE. SO THE LOT AREA IS 2,285 SQUARE FEET. UH, SO THAT WOULD BE ONE OF THE ZONE VARIANCE REQUESTS TODAY. OKAY. SECOND, UM, WHERE THE APPLICANT INTENDS TO BUILD DOES NOT MEET, UH, THE EASTERN SIDE YARD SETBACK, WHICH IS FIVE FEET SHOWN ON THE LEFT, THE REAR YARD SETBACK, WHICH IS 25 FEET SHOWN NEAR THE TOP. AND THEN WHILE THE STRUCTURE WOULD MEET THE 20 FOOT FRONT YARD SETBACK, PARKING IS TYPICALLY NOT PERMITTED WITHIN A FRONT YARD OR A STREET FACING SETBACK AREA. SO THEY'RE ASKING TO ALLOW FOR PARKING SPACES WITHIN THAT 20 YARD FRONT YARD SETBACK. UM, IN THE STAFF REPORT I REFERENCED THE, UH, EXHIBIT A REVISED EXHIBIT A. THE APPLICANT DIDN'T QUITE SHOW THE REAR LOT LINE CORRECT ON THIS. SO THE 25 FOOT REAR YARD SETBACK WASN'T QUITE WHERE IT NEEDED TO BE. SO THIS IS WHAT'S BEING ASKED FOR. SO ESSENTIALLY ALLOWING A ZERO FOOT PARKING SETBACK AT THE BOTTOM THERE TO HAVE VEHICLES PARKED IN WHAT WOULD BE THE DRIVEWAY, UH, [00:15:01] FOUR FOOT SIDE YARD SETBACK ON THE LEFT, AND THEN, UH, REAR YARD SETBACK REDUCED TO 14 FEET. UM, REAR YARD SETBACKS ARE A LITTLE DIFFERENT ON A TRIANGULAR OR NON RECTANGULAR SHAPED LOT. THE REAR LOT LINE IS ACTUALLY CREATED VIA, UM, A DEFINITION IN WHICH A 10 FOOT, ESSENTIALLY I WOULD DESCRIBE IT AS A 10 FOOT POLE IS SETBACK AS FAR AS POSSIBLE ON THE LOT. AND THAT IS CONSIDERED WHERE THE REAR REAR SETBACK LINE WOULD BE MEASURED FROM. UM, SO IT'S UP A LITTLE CLOSER THAN THE BACK END OF THE TRIANGLE. UH, HERE ARE THE APPLICANT'S FLOOR PLANS WITH ALL THREE FLOORS. AND THEN ON THE LEFT HAND SIDE YOU HAVE THAT THIRD FLOOR. UM, THERE ARE DECKS, AND SO THE ACTUAL HABITABLE SQUARE FOOTAGE IS LIMITED TO THIS 534 SQUARE FOOT AREA. UM, HERE ARE THE ELEVATIONS, UH, HAS ESSENTIALLY A KIND OF A CUSTOM TOWNHOUSE STYLE. UM, AND AGAIN, OUR, OUR ZONING CODE IN THE RS TWO ZONE DOESN'T ALLOW A THIRD STORY. SO THE RED AREAS WOULD BE ESSENTIALLY WHAT WOULD NOT NORMALLY BE PERMITTED. UM, HOWEVER, IN THE ZONING DISTRICT, THE MAXIMUM HEIGHT IS 35 FEET. THEY WOULD BE MEETING THE MAXIMUM HEIGHT AS FAR AS FEET ARE CONCERNED. SO AS FAR AS STAFF ANALYSIS, THE PROPOSAL IS CONSISTENT WITH OUR GENERAL PLAN. UH, INFILL DEVELOPMENT IS ENCOURAGED BY THE GENERAL PLAN. WE HAVE A POLICY TO PROMOTE INFILL DEVELOPMENT, REDEVELOPMENT, REUSE EFFORTS WITHIN THE CITY. UM, THIS WOULD BE A SITE THAT WOULD ORDINARILY NOT BE ABLE TO BE BUILT UNDER THE CURRENT OR UNDER ALL THE ZONING RULES. UM, AND BECAUSE IT'S A, A HOMEOWNER PROPOSING THIS, IT ALSO PROVIDES AN ADDITIONAL HOME OWNERSHIP OPPORTUNITY, WHICH IS TALKED ABOUT IN OUR HOUSING AT HELMET AS WELL. UM, WE DO HAVE GENERAL PLAN DENSITIES, UM, FOR THE, I THINK IT'S LOW DENSITY, UH, GENERAL PLAN DESIGN DESIGNATION BECAUSE OF THE SIZE OF THE LOT, THIS WOULD EXCEED, UH, TRADITIONALLY WHAT GENERAL PLAN DENSITY WOULD BE REQUIRED OF THIS AREA. HOWEVER, UNDER THE ZONING, UH, IT ALLOWS FOR AT LEAST ONE UNIT PER LOT. SO IT'S MEETING THAT AND AT, AT A NEIGHBORHOOD SCALE. UM, THE OVERALL DENSITY IS LIMITED BY THE AVERAGE SIZES OF THE LOTS AND THE IMMEDIATE VICINITY, UH, AS WELL AS THE ABUTTING FREEWAY AND EVEN THE PARK. THERE'S A LOT OF SPACE THAT ISN'T AVAILABLE FOR DEVELOPMENT IN THIS AREA THAT LIMITS THE DENSITY. LOOKING FURTHER INTO OUR CODE, SOME OF THIS I'VE ALREADY TALKED ABOUT, BUT IN UNDER THE RS TWO ZONE WHERE THIS PROPERTY IS LOCATED AND WITHIN OUR GE GENERAL DEVELOPMENT STANDARDS, UM, THERE ARE SEVERAL SECTIONS THAT AREN'T BEING MET BY THE PROPOSAL. UH, SO AGAIN, THE 5,000 SQUARE FOOT MINIMUM LOT AREA REQUIREMENT, UM, IT'S LESS THAN HALF OF THAT. AGAIN, SIZE AND SHAPE OF THE CURRENT LOT IS FROM BASICALLY THE FREEWAY CONSTRUCTION DAYS. UM, THE 20 FOOT FRONT YARD SETBACK IN THIS CASE, WE'RE ONLY TALKING ABOUT IT IN RELATION TO PARKING. IN OUR CODE, IT SAYS NO PARKING WITHIN STREET FACING SETBACKS, EXCUSE ME. UH, SO ZERO FOOT IS REQUESTED FOR THE PARKING. OUR CODE ALSO SAYS NO TANDEM PARKING IS ALLOWED OUTSIDE OF THE WEST SIDE SPECIFIC PLAN. UM, IN THIS CASE, THEY'LL BE PARKING A VEHICLE IN FRONT OF THE GARAGE, WHICH WOULD ESSENTIALLY RESULT IN TANDEM PARKING AS WELL. UM, ONE OF THE REASONS THEY ARE ASKING FOR THAT PARTICULAR ASPECT OF THE VARIANCE IS THAT OUR CODE REQUIRES TWO PARKING SPACES FOR A SINGLE FAMILY RESIDENCE, ONE UNCOVERED AND ONE UNCOVERED. UH, SO THIS WILL ALLOW THEM TO MEET THAT PARKING REQUIREMENT IN THE CODE. UM, THE REQUIREMENT FOR INTERIOR YARD SIDE YARD SETBACK IS FIVE FEET. UM, ON THE EAST SIDE, THE APPLICANT IS REQUESTING FOUR FEET. UM, 25 FEET IS REQUESTED OR REQUIRED FOR THE REAR GUARD SETBACK. ULTIMATELY, THE APPLICANT IS REQUESTING 14, AS WE SAW EARLIER. THE SECOND FINDING IS THAT THE SHALL BE GRANTED, UM, IN A WAY THAT DOESN'T AUTHORIZE A GRANT OF SPECIAL PRIVILEGES, UM, THAT OTHER PROPERTIES IN THE VICINITY ZONE, UH, ARE NOT ENJOYING. UH, SO FOR EXAMPLE, UM, ARE THERE OTHER EXISTING PROPERTIES THAT HAVE THE SAME CONDITIONS THAT WE'RE SEEING HERE TODAY? UM, AND BASED ON STAFF RESEARCH, THERE ARE OTHER DEVELOPED LOTS IN NATIONAL CITY, MUCH LESS THAN 5,000 SQUARE FEET. UH, IN PARTICULAR, THERE ARE OTHER LOTS, UH, ALONG 8 0 5 FREEWAY AND, UM, DIVISION STREET WHERE OUR STREET GRIDS START TO BE MODIFIED, WHERE YOU GET MORE TRIANGULAR SHAPED LOTS IN LESS THAN 5,000 SQUARE FEET. UH, SO THERE ARE OTHERS MORE LOTS IN THE CITY. UM, THERE ARE ALSO SEVERAL PROPERTIES WITHIN THE CITY THAT HAVE REDUCED SETBACKS AS APPLICANT IS REQUESTING. UM, ONCE AGAIN, UH, YOU HAVE THE TRIANGULAR SHAPE LOTS IN OTHER PARTS OF THE CITY, YOU HAVE REVERSE CORNER LOTS. THOSE ARE LOTS WHERE THE HOME IS CONSTRUCTED IN A, IN A DIFFERENT SITUATION THAN, UH, UH, FACING A DIFFERENT DIRECTION THAN THE WAY THE LOT WAS REALLY INTENDED. UM, AND THEN YOU HAVE TOPOGRAPHIC, UH, ISSUES WITH SETBACKS IN THE CITY. WE HAVE SOME ENTIRE SUBDIVISIONS WITH REDUCED REAR YARD SETBACKS, FOR EXAMPLE. UM, AS FAR AS THE HEIGHT GOING ABOVE TWO STORIES, NATIONAL CITY IS VERY OLD. WE HAVE, UH, HISTORIC HOMES THROUGHOUT THE CITY, UH, THAT ARE THREE STORY TALL. THESE ARE OUR OLD HISTORIC VICTORIA MANSIONS. IF YOU AREN'T AWARE THAT WE HAVE QUITE A FEW OF THEM. UM, AND THEN GOING INTO PARKING AND FRONT YARD SETBACK, UH, WE HAVE HOUSES CONSTRUCTED THROUGH ALL THE DECADES SINCE THE 1880S. SO, UH, QUITE A FEW OF THE HOUSES IN THE CITY IN THE RS TWO ZONE, UH, WERE BUILT WHEN THERE WAS NO RESTRICTION ON PARKING IN THE FRONT YARD. UM, SO THERE, THAT'S THE PREEXISTING CONDITION FOR A LOT OF HOMES IN THE CITY, AND PEOPLE TAKE ADVANTAGE OF THAT AND PARK IN THE DRIVEWAY. THE THIRD FINDING, I LEFT TWO UP THERE, UNFORTUNATELY, UM, IS THAT A VARIANCE SHALL NOT BE GRANTED, WHICH AUTHORIZES A USE THAT IS NOT ALLOWED EXPRESSLY ALLOWED WITHIN THAT ZONE. UM, SO IN THIS CASE, THE PROPOSAL IS A SINGLE FAMILY RESIDENCE, WHICH IS PERMITTED IN THE RS TWO ZONE. AND THEN WHEN WE'RE TALKING ABOUT PARKING IS CONSIDERED AN ACCESSORY USE TO THE PRIMARY USE, ALSO ALLOWED IN ALL ZONES. AND FURTHERMORE, THEY'RE REQUESTING THE PARKING ABILITY TO MEET THE CONFORM WITH THE MINIMUM PARKING REQUIREMENTS MOVING FORWARD. UNDER THE CALIFORNIA ENVIRONMENTAL ENVIRONMENTAL QUALITY ACT, UH, STAFF'S DETERMINATION IS THAT THE PROJECT WOULD BE EXEMPT FROM CQA UNDER CLASS THREE, WHICH IS THE CONSTRUCTION OF, UH, SMALL STRUCTURES. UM, IT EXPLICITLY EXEMPTS SINGLE FAMILY HOMES. UM, THAT'S WHY THAT ONE WAS CHOSEN. UM, AND THEN THE CONDITIONS OF APPROVAL, WE HAVE OUR STANDARD CONDITIONS OF APPROVAL FOR NEW DEVELOPMENT PROJECTS. UH, THE FIRE DEPARTMENT PROVIDED COMMENTS ON THIS PROJECT, UM, AND STAFF IS REQUESTING AN UPDATED SITE PLAN TO, UH, CORRECT THE REAR LOT LINE MISTAKE. UM, AND AS I MENTIONED EARLIER, THE PROPOSED USE IS CONSISTENT WITH THE GENERAL PLAN. THE RESIDENCE IS A PERMITTED USE. AND, UH, TITLE 18 PERMITS ZONE VARIANCES WITH THE FINDINGS THAT WE HAVE DISCUSSED TODAY. SO THAT'S A DEVIATION HE IS ASKING FOR TO BE ABLE TO, SO THAT I UNDERSTAND THIS, I'M REITERATING IT IS HE'S ASKING TO COUNT THE DRIVEWAY THAT'S WITHIN THE SETBACK AS A DEVIATION FOR PARKING? CORRECT. AND WE WOULD, WE WOULD, IF IT CAME IN AS A BUILDING PERMIT, WE WOULD DENY IT FOR TWO REASONS. ONE IS NO PARKING IN A STREET FACING SETBACK, AND THE SECOND WOULD BE NO TANDEM PARKING IS ALLOWED OUTSIDE THE WEST SIDE SPECIFIC PLAN. SO TANDEM PARKING IS WHEN YOU HAVE A CAR STACKED IN, IN THIS SITUATION, THAT'S WHAT WOULD OCCUR, UM, BECAUSE THE CAR IN THE DRIVEWAY WOULD, WOULD ESSENTIALLY BLOCK THE CAR THAT'S INSIDE THE GARAGE. UM, THE OTHER THING IS, WHICH WILL BE TALKED ABOUT LATER TODAY, THERE IS A PROPOSED REZONING FOR THIS AREA, WHICH WOULD CONVERT THIS LOT TO A MIXED USE PROPERTY. UM, BUT THAT HAS NOT BEEN APPROVED YET. AND SO IF YOU'RE BUILDING A HOUSE, THE APPLICANT MAY NOT NECESSARILY WANT TO WAIT TO BE ABLE TO SUBMIT FOR BUILDING PERMITS. UM, AND THEN THEY WOULD STILL RUN INTO THE SAME ISSUE WITH PARKING. OUR MIXED USE ZONE IS INTENDED TO BE WALKABLE, OR OUR MIXED USE ZONES ARE INTENDED TO BE WALKABLE, SO WE DON'T ALLOW OPEN PARKING WITHIN THE FRONT OF THE BUILDING, SO THEY WOULD HAVE TO HAVE A DIFFERENT CONFIGURATION IF THEY WENT THROUGH THAT ANYWAYS. UM, AND SO IF YOU LOOK AT THE, THE PLANS, LOOKING AT THE FLOOR PLANS AT THE FIRST LEVEL, A ONE CAR GARAGE TAKES UP A DECENT AMOUNT OF THE BUILD HAD HABITABLE AREA, BUT IF THEY WERE TO PUT A TWO CAR GARAGE ON THIS SITE, IT WOULD REALLY TAKE UP A LOT OF SPACE.
